The Writ of Habeas Corpus: Steven Miller’s attempts to suspend it

Habeas Corpus is enshrined in Article 1 of the Constitution.

The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.‍

New York Times reporters, Maggie Haberman and Johnson Swan, have reported previously about the coverup in the Situation Room of the Epstein files. Now they are reporting that Trump was considering suspending a Constitutional right. Secret memos revealed that the White House debated last year whether to limit Habeas Corpus right for undocumented immigrants.‍‍

What are the Presidential Emergency Action Documents?

“Thisis an account of the authorities, many of them top secret and higher, that permit President Donald Trump and his more knowledgeable senior aides to carry on their violent and vicious attacks on minorities and those who disagree with them and their policies with legislative and even legal impunity.‍

The answer lies in most cases with what are known as Presidential Emergency Action Documents (PEADs), which have enabled Trump today and his predecessors before him to suspend fundamental constitutional rights, detain civilians, seize property, impose martial law, and censor communications. These extraordinary powers have been put to widespread use by Trump and his aides, such as White House Deputy Chief of Staff Stephen Miller and Director of the Office of Management and Budget, Russell Vought. They have acted with no congressional authority, no judicial review, and no statutory mechanism for Congress to terminate their powers, once activated, as they have been since Trump took office”. – Seymore Hersch

White House deputy Chief, Steven Miller, head of Trump’s deportation campaign, wanted to get rid of the key Constitutional right, which compels the government to explain in court why it has detained a person. Miller’s agenda was to deny immigrants in custody from accessing hearings or court orders blocking their deportation.

The Fundamental Importance and Risks‍‍

Habeas Corpus is the most fundamental right guaranteed in the Constitution and the bedrock of democracy. Everyone is guaranteed the right to appear in court. You cannot just kidnap and disappear people. They have the right to be presented before a court of law.‍

Will Scharf, an attorney serving as White House staff secretary, was alarmed by what he read in Miller’s draft, So, On April 29, 2025, Scharf wrote a secret memo to White House chief of staff, Susie Wiles, pointing out the legal pitfalls of suspending habeas corpus. In October he also wrote another memo to Wiles which warned against invoking the Insurrection Act, another legally questionable idea floated by Steven Miller and Vice President Vance following the protests in Minneapolis.‍‍

No matter where you are in the world, the writ of Habeas Corpus, the right of Habeas Corpus, is the one term that everyone, every lawyer, every court, every judge holds sacrosanct, and Steven Miller wants to revoke it.‍‍

Only Congress has the right to suspend Habeas Corpus and only if there is an invasion or insurrection. Steven Miller wanted Trump to have the power to detain and deport immigrants, with no Habeas Corpus rights. In this scenario, the detained immigrants would be blocked from receiving a hearing or even seeking court orders to prevent their removal from the country. We have already seen this take place; deportation without representation.

After Alex Pretti was murdered (shot in the back) by federal agents in Minnesota in January, administration officials, led by Vice President JD Vance and Miller, revived the idea of using the Insurrection Act. Ultimately, it wasn’t invoked, and the government also did not suspend habeas corpus.‍

Declaring an insurrection would not only remove the rights of immigrants but would revoke our rights to Habeas Corpus and all of our democratic rights as enshrined in the Constitution and the Bill of Rights. Do we understand this? Not just immigrants; all of us!

Let’s not forget, Vice President Vance is the man who wants to be the next president of the United States. He was pushing to end our fundamental Constitutional rights.

“But the Trump administration has still continued to use authoritarian means to implement the president’s mass deportations, treating immigrants who have been in the country for decades as if they have just shown up at a U.S. border. The fact that Trump has not resorted to extreme legal arguments is only a minor victory as violent deportations and draconian immigration policies continue, as he considers federal courts inconvenient obstacles rather than a constitutionally mandated check on his power.”

We, as Americans, whether Republican or Democrat, must value our Constitution as the bedrock and guiding document of our democracy. We must continue to fight back the attempts by the White House to erode Habeas Corpus and the judicial branch of our government.
